The present study tried to objectify the knowledge of LTE of healthcare personnel at an institute in Medellín using a self-administered survey that allowed conducting a cross-sectional descriptive study with non-probabilistic sampling. Within the results, 56.5 % of respondents understood the concept of LTE, and 90 % applied it actively. This work, in English "Struggle for power, organic crisis and judicial independence", has its origin in research academics of the IAEN carried out to provide expert advise to the Inter American Court of Human Rights in the case Quintana and others (Supreme Court of Justice) vs the State of Ecuador. The research is about the nature of the evolution of the ecuadorian state, the dynamics of its institutions, its players, parties, laws, its factors of instability, the way rights have been (...) deployed since the return to democracy in 1979, those who have benefited from neoliberal democracy and those who have paid the costs, and where in all this was the Supreme Court of Justice. The Introduction takes a look at this origin of the work and its intellectual import, provides a brief characterization of the Inter American Sistem of Human Rights Protection, how the Quintana Case fits within it, and an overview of the chapters and their logic. The first chapter analyzes the institutional and sociological factors that have contributed to Ecuador's historically unstable state, based primarily in an antagonistic struggle for power between the Executive and Legislative branches. The second chapter analyzes the economic and political factors that provoked an organic crisis, or crisis of hegemony, between 1997 and 2007 in Ecuador. The third chapter analyzes the evolution of the way in which judges are selected in Europe, the outcomes they have generated, and how they compare with the ecuadorian systems of judge selection in terms of securing judicial independence. The fourth chapter develops a theory of judicial independence in democracy and analyzes how Ecuador measures up to that standard, from when it became a neoliberal minimal democracy in 1981, to when it became a neoliberal false democracy as a consequence of instalation of a system evidently lacking in the people's support under the guise of the 1998 Constitution and its system of judge selection, and the new democratic horizons set by the 2008 Constitution, and the judicial system that springs from it. Adherence to professional ethics in nursing is fundamental for high-quality ethical care. However, analysis of the use and impact of nurses’ codes of ethics as a part of professional ethics is limited. To fill this gap in knowledge, the aim of our review was to describe the use and impact of the Code of Ethics for Nurses with Interpretive Statements published by the American Nurses Association as an example of one of the earliest and most extensive codes of ethics for (...) nurses with their interpretative statements and constituting a strong basis for the International Council of Nurses’ Code of Ethics for Nurses. We based our review on previous literature using a scoping review method. We included both non-scientific and scientific publications to provide an analysis of codes of ethics which can be utilized in development and revision of other nurses’ codes of ethics. In the searches, we used CINAHL and PubMed databases limiting publications to texts with a connection to the Code of Ethics for Nurses published from January 2001 to November 2022 and written in English. Searches yielded 1739 references, from which 785 non-scientific and 71 scientific publications were included for analysis of the data. Although non-scientific and scientific publications addressed different number of categories, the results indicated that in the both groups the use and impact focused on professional ethics, nursing practice, and work environment and less on education, research, or social health issues. Nurses’ ethical standards were not addressed in non-scientific publications, and clinical issues and leadership were not in focus in scientific publications. To increase evidence-based knowledge of the impact of codes of ethics additional research is needed. Good scientific conduct was followed. (shrink)

The education of the emotions is a valuable tool not always taken into account in the development of the democratic, egalitarian background essential to empower citizens. Perhaps the difficulty lies in the fact that, firstly, it is necessary to probe the possibilities of educability of emotions. Martha Nussbaum is one of the contemporary philosophers who have devoted much of their work to the study of emotions, and from her theory, conclusions can be drawn about the question of their educability. (...) Her theory of emotions can be situated within a set of theories that understand emotions as cognitive, which turns literature into a useful tool for their education. However, the author does not put forward an explicit methodology for such development from narrative. To this end, in this interview Nussbaum is asked about the concept of self-conscious reflection as a feasible proposal to enable the education of emotions, as well as about whether a list of “democratic emotions” can be built from her theory. Also, in this context, Nussbaum responds and elaborates on these themes. (shrink)

Resumen La educación de las emociones ha sido promovida recientemente desde el giro afectivo en las ciencias sociales. Sin embargo, gran parte de los análisis educativos no tratan las emociones llamadas políticas o públicas, definidas por Martha Nussbaum como aquellas relacionadas con el Estado, sus instituciones y los conciudadanos. Este artículo presenta una guía para una educación ciudadana basada en emociones políticas, fundamentando que su educabilidad está habilitada por el desarrollo de la autorreflexión y que, a partir de ello, (...) es posible determinar categorías de emociones que favorecen la convivencia democrática, como son su adecuación, su direccionamiento y su apertura o clausura de las fronteras del yo. Esas categorías, inspiradas en los trabajos de Martha Nussbaum, Jon Elster y Adela Cortina, se ofrecen como guía metodológica para una educación ciudadana que procure el cultivo de la autorreflexión en relación con las emociones políticas. Dicha guía podría superar la actual dificultad tanto de enseñar como de evaluar la dimensión política de las emociones en la educación formal.The education of emotions has recently been promoted by the affective turn in the social sciences. However, most of these approaches to emotions fail to undertake a work in the field of emotions called political or public, as defined by Martha Nussbaum as the emotions that refer to the State, its institutions and the fellow citizens. This article seeks to present a guide for a citizen education based on political emotions, on the grounds that their educability is enabled by the development of self-conscious reflection and that it is therefore possible to determine categories of emotions that favor democratic coexistence, such as their adequacy, their direction and their opening or closing of the borders of the self. These categories, inspired by Martha Nussbaum’s, Jon Elster’s and Adela Cortina’s works, are offered as a methodological guide for a citizen education that seeks the cultivation of self-conscious reflection in relation to political emotions. This guide could overcome the current difficulty of both teaching and evaluating the political dimension of emotions in formal education. (shrink)

The article is the result of the research project “Higher Education in Humanistic Perspective: An Approach from Martha Nussbaum”, having Nussbaum’s book Cultivating Humanity: A Classical Defense of Reform in Liberal Education as the main referent for the considerations presented. Hermeneutics is used as the philosophical method. One of the purposes of the article is to reveal how higher education courses in human development might be transformed from the perspective of self-examination in Martha Nussbaum’s thought, understanding the latter (...) as one of the three skills required for cultivating humanity. Self-examination is related to Bioethics in two different ways: first, by considering the current scientific context where some relevant issues arise and, second, it is exposed how its practice, by being in close relationship to the ethical and bioethical training of future professionals, is relevant for higher education teaching. Therefore, the consideration here presented is relevant and necessary precisely at a time when science progresses rapidly and not likewise the sense of humanity that should underlie and guide the actions of those involved in scientific progress and Health Care. Three topics are presented in the article: some considerations regarding the importance of bioethical thought, an approach to the particular meaning of Martha Nussbaum’s “self-examination”, and the examination of oneself and human formation related to Bioethics. Este ensayo considera, dentro de un contexto narrativo, el asunto de cómo llegar a saber de nuestro amor a partir de una comparación entre el comportamiento escéptico y desconfiado del lector de filosofía y el abierto y confiado del lector de relatos. El artículo explica cómo la filosofía permite clarificar la idea del conocimiento del amor por medio del análisis de los conceptos, descubriendo específicamente que es el amor en el alma y como es su conocimiento; y cómo el relato, (...) señala que el carácter las multiples formas de los aspectos en desarrollo y la evolución temporal de lo narrado, no están presentes en las teorías explícitas y reflexivas. Martha Nussbaum afirma que el corazón humano necesita de la reflexión activa, y que para poderle abrir un espacio a las historias de amor, la filosofía debe ser más literaria, debe tener una relación más estrecha con las narraciones y considerar respetuosamente el misterio y los finales abiertos de las mismas. This powerful and elegantly written book, by one of America's most influential philosophers, presents a critique of the role that shame and disgust play in our individual and social lives and, in particular, in the law.Martha Nussbaum argues that we should be wary of these emotions because they are associated (...) in troubling ways with a desire to hide from our humanity, embodying an unrealistic and sometimes pathological wish to be invulnerable. Nussbaum argues that the thought-content of disgust embodies "magical ideas of contamination, and impossible aspirations to purity that are just not in line with human life as we know it." This paper suggests the democratic direction in which the right of freedom of expression should be conceived and applied. In the first two sections it suggests some counter-examples to, and diagnoses of, the libertarian and liberal conceptions of freedom of expression, taking Scanlon (1972) and Scanlon (1979), respectively, to be their chief proponents. The paper suggests that these conceptions cannot take into account clear examples, like fraudulent propaganda, which should not be legal. The democratic conception takes it to heart that (...) the pillars upon which the right of freedom of expression is founded are individual and collective autonomy, the right to know facts of public interest and information necessary for effective democratic control of government. The paper suggests that in a time when private powers seriously threaten these pillars, it is correct for the government to step in to provide the framework in which genuine discussion geared toward fulfilling the objectives of these pillars can take place. This volume brings together Nussbaum's published papers on the relationship between literature and philosophy, especially moral philosophy. The papers, many of them previously inaccessible to non-specialist readers, explore such fundamental issues as the relationship between style and content in the exploration of ethical issues; the nature of ethical attention and ethical knowledge and their relationship to written forms and styles; and the role of the emotions in deliberation and self-knowledge. Nussbaum investigates and defends a conception of ethical understanding which involves (...) emotional as well as intellectual activity, and which gives a certain type of priority to the perception of particular people and situations rather than to abstract rules. She argues that this ethical conception cannot be completely and appropriately stated without turning to forms of writing usually considered literary rather than philosophical. It is consequently necessary to broaden our conception of moral philosophy in order to include these forms. Cover, dans les deux textes traduits dans cet ouvrage, invitent à reprendre la réflexion sur ces sujets.

In this article, we explore the learning of newcomers in a religious community through a micro-sociological approach, making use of Jean Lave and Etienne Wenger’s (1991) notion of “legitimate peripheral participation” to conceptualize initial stages of inclusion and involvement in social practice. Our case study concerns Orthodox Christianity and is based on material gathered through fieldwork in a course targeting potential new members organized by a Finnish Orthodox parish. In the analysis, we inquire into how beginners learn skilful participation in (...) Orthodox liturgical life, and specifically embodied ritual conduct. This learning takes place primarily through participation in real-life divine services. The article highlights challenges faced by beginners in acquiring the embodied repertoire of Orthodox ritual, including adapting to the artistic use of ritual gestures, and negotiating the meanings produced through them. Furthermore, it also illustrates how nuanced dynamics between newcomers and old-timers influence the learning process. (shrink)

Foucault sostiene que, en las sociedades modernas de Occidente, la comunidad política, y más precisamente la política misma, ha sido el terreno de la guerra librada por otros medios. Por extensión, esta tesis significa invertir el principio de von Clausewitz; a saber, que la guerra es (...) la continuación de la política por otros medios. On the basis of the difference between M. Foucault and Th. Hobbes regarding war as a principle and foundation of power, the article shows the importance of this conceptual difference for contemporary political analyses. Foucault argues that in modern Western societies, the political community and, more specifically, politics itself, has been the space of a war waged by other means. By extension, this thesis entails the inversion of von Clausewitz's principle, namely, that war is the continuation of politics by other means. A partir da divergência de M. Foucault com Th. The recent nationalist movements in liberal democratic states such as the US, the UK, and Germany have been related to xenophobia. The rise of Trumpism brands Muslims and Mexicans as outsiders, while part of the motivation behind Brexit was animosity towards non-Britons like Poles and Muslims. The question is how are nationalism and xenophobia related. According to Ronald Sundstrom, nationalism shelters xenophobia by creating obstacles that prevent immigrants and refugees from attaining a sense of civic belonging. He uses the metaphor (...) of sheltering to suggest that xenophobia becomes a byproduct of nationalism in the right conditions. I think this is a misunderstanding of the relationship between nationalism and xenophobia. In this essay, I do three things: first, I articulate Sundstrom’s argument explaining how each of the three obstacles works to produce an environment of xenophobia; then I consider what reforms might look like, yet these reforms would no longer leave us with something that we can recognize as nationalism; lastly, I argue that nationalism just is the modern day manifestation of xenophobia and so they are inseparable social phenomena. Este artículo aborda los efectos del voto preferente en el sistema de partidos políticos colombiano a la luz de las elecciones al Senado de la República entre el año 2006 y 2018. Específicamente se pregunta por los incentivos institucionales para los actores políticos en relación con la reputación partidista o personal y sus efectos reales en el comportamiento electoral de los partidos políticos. Teórica y metodológicamente se parte del paradigma post-positivista, de un enfoque neoinstitucional desde la elección racional y de (...) una metodología mixta, que combina instrumentos y técnicas cualitativas con indicadores cuantitativos. Se identifica la estructura de incentivos del sistema electoral colombiano a partir de las normatividades legales utilizadas y se utilizan indicadores cuantitativos para analizar el comportamiento de los actores políticos en relación con dichos incentivos. Este ejercicio se fundamenta en la necesidad de realizar un estudio sistemático y prolongado en el tiempo de los efectos de la Reforma Política del 2003, especialmente de uno de sus instrumentos con mayor influencia en las decisiones políticas de maximización de beneficios y disminución de costos: el voto preferente. A pathbreaking new study of women and morality How do people decide what is "good" and what is "bad"? How does a society set moral guidelines -- and what happens when the behavior of various groups differs from these guidelines? Martha Saxton tackles these and other fascinating issues in Being Good , her history of the moral values prescribed for women in early America. Saxton begins by examining seventeenth-century Boston, then moves on to eighteenth-century Virginia and nineteenth-century St. Louis. (...) Studying women throughout the life cycle -- girls, young unmarried women, young wives and mothers, older widows -- through their diaries and personal papers, she also studies the variations due to different ethnicities and backgrounds. In all three cases, she is able to show how the values of one group conflicted with or developed in opposition to those of another. And, as the women's testimonies make clear, the emotional styles associated with different value systems varied. A history of American women's moral life thus gives us a history of women's emotional life as well. In lively and penetrating prose, Saxton argues that women's morals changed from the days of early colonization to the days of westward expansion, as women became at once less confined and less revered by their men -- and explores how these changes both reflected and affected trends in the nation at large. This paper attempts a renewed understanding of the concept of poetic reason, key in María Zambrano’s philosophical writings, from a hermeneutical approach. Poetic reason might be seen in this light as a gateway to a different kind of rationality, one that might help to enrich its ontological and anthropological implications, and overcome the hubris that has been historically ingrained in this concept. The paper is structured in three parts: in the first one, an attempt will be made to show a (...) reform of the understanding, which involves human life integrally, in such a way that reason transcends and makes it possible to understand the historical complexity of man and the urgent need to return to oneself. In the second, special attention will be focused on Zambrano’s new humanism, based on poetic and merciful reason, as an antidote to the ghost of war. And the third section delves in the work Claros del bosque to point to the reader the three hermeneutical moments that they will possibly face when trying to understand the realm of poetic reason. En este trabajo se intentan mostrar algunas tensiones entre el discurso de la conservación, el multiculturalismo y los prejuicios racistas, tomando como punto de referencia el caso de los Montes de María en el Caribe colombiano, donde han tenido lugar proyectos de cooperación a propósito de la biodiversidad y existen iniciativas locales para su conservación. Se describen tres niveles en los que pueden encontrarse los prejuicios racistas en el discurso de la conservación, y las tensiones que los caracterizan, asociadas tanto (...) a las ideas de resistencia y de comunidad, como a la necesidad de corrección de las prácticas por parte de quienes habitan los bosques. El propósito de estas reflexiones es cuestionar el discurso de la conservación y el multiculturalismo para ampliar las perspectivas frente a las apuestas por la conservación y las luchas étnico-campesinas que se llevan a cabo en la alta montaña de los Montes de María, similares seguramente a otros casos en América Latina.
